These Terms and Conditions ("Terms") govern your access to and use of the website newtra.in, the Newtra mobile application, and all related services provided by Project-R Mobility Private Limited ("Newtra", "Company", "we", "us"). By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our Services.

These Terms constitute a legally binding agreement between you ("User", "you") and Newtra. We reserve the right to update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms.

To use our Services, you must:

• Be at least 16 years of age (or 18 if your jurisdiction requires)

• Have the legal capacity to enter into a binding contract

• Provide accurate, current, and complete information during registration

• Not be prohibited from using our Services under applicable laws

By creating an account, you represent and warrant that you meet all eligibility requirements. Newtra reserves the right to refuse service to anyone for any reason at any time.

You agree not to use the Services to:

• Violate any applicable local, state, national, or international laws

• Ride in areas outside designated zones or geofenced boundaries

• Tamper with, damage, or attempt to circumvent the locking or GPS mechanism

• Carry the bicycle into private or restricted areas

• Sublet, hire, or transfer your account to another person

• Use fraudulent payment methods or chargeback abuse

• Engage in any conduct that may damage, disable, or overburden our infrastructure

• Collect or scrape data from our platform without written permission

• Upload or transmit any harmful, offensive, or unlawful content through the platform

To the fullest extent permitted by applicable law, Newtra shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from your use of the Services

• Physical injury or property damage resulting from improper use of the bicycles

• Loss of data, revenue, or profits

• Service interruptions due to maintenance, technical issues, or force majeure

Newtra's total liability for any claim related to the Services shall not exceed the amount you paid to Newtra in the six (6) months preceding the event giving rise to the claim.

You are responsible for the safe use of the bicycle during your ride. In the event of damage to a Newtra bicycle or docking station caused by misuse, negligence, or breach of these Terms, you may be charged for repair or replacement costs. Damage charges will be communicated via email and deducted from your registered payment method. We encourage you to report any pre-existing damage before starting a ride to avoid liability.

Newtra reserves the right to suspend or permanently terminate your account at its sole discretion if:

• You breach any provision of these Terms

• You engage in abusive or threatening behavior toward staff or other users

• Your account is involved in fraudulent transactions

• Required by law or court order

You may also delete your account at any time from the app settings. Upon termination, unused wallet balance will be refunded as per our Refund Policy.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.
